Terms of use
These terms are the agreement between you and Burak Altıntaş for the Notanica app and website. By creating an account or using the app you accept them.
Contents
The service
Notanica lets you scan or import sheet music, read and play it, practise, learn music theory, and work with teachers and classes. You need an account.
Automatic reading of sheet music is not perfect. Check the result before you rely on it, for example in a concert or an exam. Lessons and suggestions do not replace a teacher.
Your account
You must be 18 or older to hold an account. Give true information, keep your sign-in secure and tell us if someone else uses it. You are responsible for what happens under your account. One account per e-mail address.
Children and guardians
A person under 18 uses a student account that a parent or legal guardian opens. The guardian consents on the child’s behalf, manages the child’s devices and teachers, and is responsible for the child’s use of Notanica. A teacher can link a minor only through the parent.
A student account becomes a normal account when the student, after turning 18, adds a sign-in method of their own. The parent’s control then ends.
Subscription and trial
Notanica offers a free trial (currently seven days) and weekly, monthly and annual plans. The price and period are shown in the store before you buy. Purchases are made through Apple or Google; we never see your payment details. Payment is charged to your Apple ID or Google Play account when you confirm the purchase, and the unused part of a free trial is lost when you subscribe.
A subscription renews automatically for the same period at the price the store then shows, unless you cancel at least 24 hours before the period ends. A trial turns into a paid plan unless you cancel before it ends. Manage and cancel in your Apple subscription settings or in Google Play. Deleting the app or your account does not cancel a subscription.
Apple or Google decide refunds under their own rules. We cannot refund a purchase made in a store.
Without an active plan or trial your library stays open: you can view and play your scores and keep correcting scores you already have. Scanning new pages and importing files need an active plan or trial, apart from the free allowance shown in the app. Plans carry fair-use limits, shown in the app.
Your music and content
You keep all rights to what you add. You give us a limited licence to store, process and display it, to read it from scans, to back it up and to show it to the people you choose, only to run the service for you.
Scan, import or contribute only music that you own, that is in the public domain, or that a licence lets you copy and share. Answer truthfully when the app asks about the rights. What you add stays private to you: Notanica does not give your scans or files to other people.
A share is an offer the recipient may accept. The recipient gets the music only, not your scan, notes or settings, and you can withdraw an offer that is not yet accepted. Offer a score to the shared library only if you have the right to publish it. Our staff verify each work and may refuse or remove it; licences that forbid commercial use or changes are not accepted.
Following a YouTube video with a score uses YouTube’s own embedded player. By using it you agree to be bound by the YouTube Terms of Service.
Copyright notices
If a work in the library or a shared score infringes your rights, send a notice on the copyright page. A code is sent to your e-mail address and the notice reaches our team after you confirm it. We review it, may remove the work and tell the person who offered it. We may close the accounts of people who repeatedly infringe.
If your content was removed by mistake, write to info@notanica.com.
What you must not do
- Break the law or infringe the rights of others.
- Add music, text or images you have no right to add, or content that is abusive, hateful, sexual or harmful to children.
- Link to or contact a minor without the parent’s consent, or ask a child for personal data.
- Work around limits, the proof that the app is genuine, or security; scrape, overload or attack the service.
- Use someone else’s account or let others use yours.
- Copy, resell or reverse engineer the app, except where the law allows it.
Changes and availability
We work to keep Notanica available but do not promise uninterrupted service. We may change, pause or end features, and some updates of the app are required. If we end the service we will tell you in the app and give you a way to export your data.
Ending
You can delete your account at any time, as described on the account deletion page. We may suspend or close an account that seriously or repeatedly breaks these terms, after a warning where we reasonably can. When an account ends, its data is deleted as the privacy policy describes.
Liability
Notanica is provided as it is. Your rights as a consumer, including under the Turkish Consumer Protection Law and the law of your country, are not affected. Beyond that, we are liable for damage caused by intent or gross negligence and, to the extent the law allows, our liability for other damage is limited to what you paid for Notanica in the last twelve months. Nothing here limits liability that the law does not allow to be limited.
Law and disputes
Turkish law applies. If you are a consumer, the mandatory consumer protection of the country where you live still applies, and you may bring a claim before the consumer authorities or courts of your place of residence.
Apple and Google
- These terms are between you and Burak Altıntaş only, not Apple or Google. We, not Apple or Google, are responsible for Notanica and its content.
- We grant you a personal, non-transferable licence to use the app on devices you own or control, under the store’s usage rules.
- We are responsible for maintenance and support (see Support). Apple and Google have no duty to provide any.
- If the app fails to meet a warranty, you may tell Apple, which will refund the price of the app; beyond that Apple has no warranty duty. Other claims about the app, including product liability, consumer protection and intellectual property claims by third parties, are ours to handle, not Apple’s.
- You confirm that you are not in a country under a US government embargo or designated as a supporter of terrorism, that you are not on a US list of prohibited or restricted parties, and that you follow third-party terms that apply to you, such as your mobile network’s.
- Apple and its subsidiaries are third-party beneficiaries of these terms for the Apple version of the app and may enforce them against you once you accept them.
- Questions, complaints and claims: Burak Altıntaş, Döşemealtı, Antalya, Türkiye, info@notanica.com.
Changes to these terms
We may change these terms, for example when the service changes. The date above shows the current version. Important changes are announced in the app before they apply; if you keep using Notanica after that, they apply to you. If you disagree, you can delete your account.
